Terms of service

These terms are the agreement between you and us when you use TryTestimonials. Please read them before creating an account. By creating an account or using the service, you agree to them.
1. About us
TryTestimonials is provided by George Ryder, a sole trader trading as RallyDigital, based in the United Kingdom (“we”, “us”, “our”). You can contact us at george@trytestimonials.com.
In these terms, “you” means the person or business that holds a TryTestimonials account. If you use the service for a business, you confirm you have authority to accept these terms on its behalf.
2. The service
TryTestimonials lets you:
- create one or more “walls”, each with a public collection link;
- send that link to your customers so they can submit written testimonials without an account;
- approve, edit or reject the testimonials you receive; and
- show approved testimonials on your own website using an embed code, or on a hosted wall page.
We may improve, change or remove features over time. If we remove a feature that is a main part of a paid plan you are on, we will tell you in advance.
3. Your account
- You must be at least 18 years old to open an account.
- You must give accurate details and keep your sign-in secure. You are responsible for activity on your account.
- Tell us straight away at george@trytestimonials.com if you think someone else has accessed your account.
4. Acceptable use
You must not use TryTestimonials to:
- publish fake testimonials, including ones you wrote yourself, ones written by people who have not used your product or service, or ones you paid for or gave an incentive for without saying so;
- publish misleading testimonials, including by editing a testimonial so it changes the meaning of what the person said, or by showing selected testimonials in a way that gives a false impression;
- break any law, including consumer protection law (such as the rules on fake reviews in the Digital Markets, Competition and Consumers Act 2024), advertising rules, data protection law or intellectual property law;
- publish content that is defamatory, hateful, harassing, obscene, or that infringes anyone else's rights;
- send spam, or collect testimonials from people who have not agreed to be contacted;
- interfere with the service, try to get around plan limits or security measures, or access data that is not yours; or
- resell or white-label the service without our written agreement.
We may remove content or suspend an account that breaks these rules. Where we can, we will tell you why and give you a chance to put things right first.
5. Your content and your responsibilities
You are responsible for your content. This includes your walls, the questions you ask, and every testimonial you approve and publish. Approving a testimonial means you are choosing to publish it.
You must have consent. Our collection form asks each person to agree that their name, role and words may be shown publicly before they can submit. You are responsible for making sure that every testimonial you publish comes from a real customer who has given that consent, and for complying with data protection law as the controller of your customers' data. If someone asks you to remove their testimonial, you must remove it promptly.
Ownership. We do not claim ownership of your content or your customers' testimonials. You give us a non-exclusive, worldwide, royalty-free licence to store, copy, format and display that content only as needed to provide the service to you. This licence ends when the content is deleted, apart from short-lived copies in backups.
Removal requests. If a testimonial giver contacts us directly and asks for their testimonial to be removed, we may remove it, and will tell you when we do.
6. Plans, billing and Paddle
We offer a Free plan, a Pro plan at $19 per month, and a Lifetime plan at $49 paid once. Prices are in US dollars and do not include sales tax or VAT, which is added at checkout. Current prices and what each plan includes are shown on our pricing page.
Paddle is our merchant of record. Our order process is run by our online reseller Paddle.com, which is the merchant of record for all our orders. Paddle provides all customer service enquiries about payment and handles returns. When you buy a paid plan, you buy it from Paddle, and Paddle's buyer terms also apply to that purchase. Paddle takes payment, charges the correct tax and issues your receipts and invoices.
Pro subscriptions renew automatically each month on the date you first subscribed, and Paddle will charge your payment method on each renewal until you cancel. If a payment fails, Paddle may try again. If it still cannot collect payment, your account will move to the Free plan.
Price changes. If we change the price of Pro, we will tell you by email at least 30 days before your next renewal at the new price. You can cancel before then if you do not want to continue.
7. The Lifetime plan
The Lifetime plan is a one-off payment that gives you the features of the Pro plan, without monthly charges, for the lifetime of the TryTestimonials service. It is not tied to your lifetime or to any fixed number of years. In particular:
- It is limited to the first 30 buyers, and we may stop selling it at any time.
- It covers one account and is not transferable.
- It includes the Pro plan's limits as they stand when you buy it (currently 3 walls and unlimited testimonials displayed). New features or higher tiers we add later may not be included.
- It is subject to fair use. If an account's use goes far beyond normal use of the Pro plan in a way that affects the service for others, we may contact you to agree a solution.
- If we ever decide to close TryTestimonials, we will give Lifetime customers at least 90 days' notice by email so you can save your testimonials.
8. Refunds
Lifetime purchases can be refunded within 14 days of payment. Pro subscription payments are not refunded. Full details are in our refund policy. Nothing in these terms affects your statutory rights.
9. Cancellation and ending your account
Cancelling Pro. You can cancel your Pro subscription at any time from your account page, or by emailing us. There is no notice period and no fee. You keep Pro features until the end of the period you have already paid for, and are then moved to the Free plan. Your testimonials are not deleted. Anything above the Free plan limits is hidden, not removed, and comes back if you upgrade again.
Deleting your account. You can delete your account at any time. This permanently deletes your walls and testimonials, and your embedded widgets will stop showing them. Deleting your account does not cancel a Pro subscription by itself, so please cancel first.
If we end or suspend your account. We may suspend or close your account if you seriously or repeatedly break these terms, if you do not pay, or if the law requires us to. Except where there is a serious breach or legal reason, we will give you notice and a chance to fix the problem first. If we close your account for reasons other than your breach, we will refund any amount you have paid for a period you will no longer receive.
10. Availability
We work to keep TryTestimonials running smoothly, but we cannot promise it will always be available or free of errors. We may need to pause it for maintenance, updates or reasons outside our control, such as outages at our hosting or database providers. The widget caches testimonials so that short outages are less likely to affect your website.
We do not guarantee any particular result from using the service, such as more sales or enquiries. You are responsible for keeping your own copy of anything you cannot afford to lose.
11. Our liability to you
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.
If you use TryTestimonials for a business (which is what it is designed for):
- we are not liable for any loss of profit, sales, business, revenue, goodwill or data, or for any indirect or consequential loss; and
- our total liability to you for all claims arising out of or in connection with these terms, whether in contract, tort (including negligence) or otherwise, is limited to the greater of the total amount you paid us in the 12 months before the claim arose and £100.
If you are a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable. You have legal rights in relation to digital services that are not as described, not fit for purpose or not provided with reasonable care and skill, and nothing in these terms affects those rights.
You agree to be responsible for, and to cover our reasonable costs of, any claim made against us by a third party arising from content you publish through the service or from your breach of section 4 or 5.
12. Changes to these terms
We may update these terms from time to time, for example to reflect changes in the law or in the service. We will update the date at the top of this page. If a change materially affects you, we will email you at least 30 days before it takes effect. If you do not agree to the change, you can cancel and stop using the service before then.
13. General
- If any part of these terms is found to be unenforceable, the rest of the terms continue to apply.
- If we do not enforce a right straight away, we can still enforce it later.
- You may not transfer your rights under these terms to anyone else without our written agreement.
- No one other than you and us has any right to enforce these terms.
14. Governing law
These terms, and any dispute or claim arising out of or in connection with them, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
